1. Preface

1.1  This website is operated by DQS Management Systems Solutions (HK) Ltd, (collectively “we” or “DQS HK”). DQS Academy is a function name of our operation.

1.2  By using our website for shopping, you agree to be bound by the following terms and the applicable terms specified in the webpage for a particular item. Please read them carefully in advance.

1.3   The meaning of some words used in these terms:

1.3.1  “we”, “us” or “our” is a reference to DQS HK.

1.3.2  “you” or “your” is a reference to the organization or person, to whom we are providing the services or delivering item and who is required to pay for the item we delivered.

1.3.3  “item” means the goods or services posted at this website for selling to customers, excluding management system certification service.

1. Order & Payment

2.1  After you place an order with the stated price, you cannot cancel the order, even if our acceptance or rejection of your order is still pending.

2.2  We will acknowledge your order by email with item names, definite prices, and expected delivery date, which will be our acceptance of your order.

2.3  The availability of the item is as shown online with stated prices, with updates from time to time. They shall not be relied on as definite statements for availability and definite prices.

2.4  We reserve our right not to accept or cancel an order at our sole discretion, for any reasons, such as insufficient stock, absence of delivery service, or incorrect price, Bonus Points, Promotion Code, or Coupon due to error by a human, system, or our supplier..

2.5  If we cancel your order we will notify you by email and will credit to your account any sum deducted by us. You accept that we will not be obliged to offer any compensation for disappointment suffered.

2.6  We use third party payment service to process online transactions. You agree and accept that some of your credit card or other online payment service related information may be collected, processed, and kept by a payment service provider subject to its terms and conditions. You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making credit card or other online payment transaction, and in no event shall any such losses in whole or in part be borne by us.

1. Delivery & Return

 3.1  Unless due to the constraints of the third-party delivery service providers’ service scope, the local regulations, or by our suppliers related to reselling, our electronic item or its access will be delivered from Hong Kong to your provided email address, via application, or as otherwise specified, and our physically items may be delivered to Hong Kong, Macau, Taiwan, and Mainland China. For an item to other locations, you shall contact us for confirmation in advance.

3.2  You shall observe all applicable laws, including obtaining all necessary customs, import or other permits, before purchasing item from our website. We make no representation and accept no liability in respect of the export or import of the item you purchase.

3.3  Unless otherwise specified, no return or exchange of item will be accepted.

1. Disclaim of Warranties and Limitation of Liability

4.1   We do not warrant that access to our website or portal (including the associated applications or software), will be uninterrupted, reliable or fault-free.

4.2   We do not warrant that our website or any of its contents will be always accurate, complete or reliable.

4.3  You agree that no data transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Any information which you transmit to us is transmitted at your own risk.

4.4  To the extent permitted by law, we exclude all liability which we may otherwise have to you as a result of:

4.4.1  any inaccuracies, errors or omissions on or relating to our website or application or any information on our website;

4.4.2   the unavailability of our website or application, item or services;

4.4.3  any item not being of merchantable quality or fit for their intended purpose; or

4.4.4  any misrepresentation on or relating to our website, the item or the services.

4.5   Save as required by law:

4.5.1  we will not be liable to you for any indirect or consequential loss, damage or expenses, including loss of profits, business or goodwill, arising out of any problem you notify to us, and

4.5.2  we will have no liability to pay any money to you by way of compensation except otherwise specified.

4.6   You agree to indemnify us and our directors, employees and suppliers, and hold us all harmless from any claim, loss, damage, cost, expense or other liability which may be incurred by us arising out of any breach of the covenants, warranties, representations and agreements herein.

1.   Bonus Points

5.1  Bonus Points accumulated will be cancelled when your user account is terminated.

5.2  Bonus Points are not applicable for the payment of delivery charge.

5.3  Bonus Points are neither transferable nor redeemable for cash.

5.4  Unless otherwise specified or offered, Bonus Points are valid for 180 days.

5.5   For online shopping at our website, you may be eligible for a rebate, in form of Bonus Points, of normally 1% of net payment of each order for training course related items in our Shop, unless otherwise offered. You may be offered Bonus Points for use of our website or for referrals our service to other customers. Net payment shall mean the amount after deduction of, where applicable, Bonus Points and any other promotional offer or rebate.

5.6  Bonus Points are only applicable for purchase of certain items as applicable at this website.

5.7 We reserve our right not to cancel or adjust the Bonus Points assigned to you due to error by a human or the system.

1. Promotion Code and Coupon

6.1    Promotion code or coupon offered by us shall only be used for one-off purchase of certain items as applicable at this website.

6.2   Unless otherwise specified, A coupon is valid for 90 days.

6.3   Promotion code or coupon is neither refundable nor redeemable for cash. Any unused amount will be forfeited.

6.4   Unless otherwise offered, the coupon is not intended to use together with other discounts.

6.5   We reserve our right not to cancel or adjust the Promotion Code or Coupon assigned to you due to error by a human or the system.

6.6   We reserve the right to terminate or change the above offers. In the event of any dispute, our decision shall be final and conclusive.

1. Others

7.1   Your access to our website, portal, application, or registration may be terminated, if you are in breach of the terms, which will not release your liabilities that have accrued before the termination.
